Virginia — Sentencing Guidelines 2026

Virginia judges use worksheets from the Virginia Criminal Sentencing Commission. Each answer below adds points. Section A decides whether the case is likely to get probation (or a short jail term) or an active sentence, which Section C then sets. This version covers burglary, larceny (theft, receiving stolen property, embezzlement), fraud (forgery, bad checks, credit card and identity fraud), drug offenses, assault (wounding, strangulation, assault on police, firearm use in a felony), robbery (including carjacking), kidnapping, weapons (felon in possession, concealed weapons, shooting into buildings) and traffic felonies (DWI third or later, driving on a revoked license, hit and run, eluding police); other offenses will be added. Only the questions the chosen offense’s worksheet uses are shown.

Has the person ever been convicted (or, as a juvenile, adjudicated) of a violent felony on the Commission’s list (Appendix A), such as robbery, malicious wounding, rape or burglary of a home? Category I: one with a maximum penalty of 40 years or more (or life). Category II: only ones with a maximum under 40 years (an attempt or conspiracy to commit a Category I crime counts here, except attempted aggravated murder).

Just having a weapon does not count.

Prior record

Prior cases: list up to the 5 most recent felony cases (adult or juvenile). If there are fewer than 5, add the most recent misdemeanor cases to make up to 5. For each case, pick the maximum penalty of its most serious offense.

For larceny, fraud and drug offenses, the Commission also checks whether the person is a good fit for a sentence other than jail or prison (for example probation with programs). It applies only when no prior or current violent felony and no mandatory jail term is involved.

Section B recommendations

Section C recommendations

Checked on 26 October 2026 against the Virginia Criminal Sentencing Commission’s 2026 Sentencing Guidelines Manual and its Burglary/Dwelling, Burglary/Other, Larceny, Drug/Schedule I/II, Drug/Other, Assault, Fraud, Robbery, Kidnapping, Weapon/Firearm and Traffic/Felony worksheets (effective July 1, 2026): every point value on each section, each Section B table, every row of each Section C table, the larceny, fraud and drug alternative-to-incarceration checks (Section D), and the maximum penalties for attempts and conspiracies (Appendix C, Figures 2 and 3). As the manual says, life maximums score the highest points, a 12-month misdemeanor counts as 1 year, and the top of the range is lowered to the total maximum penalty of the convictions entered. Where a worksheet prints no points for a maximum penalty you enter, that offense is left out and the result says so. Larceny: an attempt or conspiracy to fail to return leased property is not estimated because the manual and worksheet disagree on how to score it; prior incarceration is scored Yes/No as on the worksheet, although the manual’s instructions mention time-served categories the worksheet does not print. Assault Section B: the additional-offenses factor is scored only when there is another offense in the case, following the manual’s explanation that a Section B total of 1 means no injury and no record. Traffic: for DWI offenses that carry a blood-alcohol level, the “additional DWI” points follow the worksheet’s wording (DWI third or fourth offense), because the manual’s table lists only the basic codes. Not included: other offense types (coming later), probation violation guidelines, and the judge’s reasons for going above or below the guidelines. Scores above the printed tables need the Commission’s own figure. This is an educational estimate, not legal advice.
